Terms and Conditions

1. Definitions

Takecarebnb: Stichting Takecarebnb, established on November 25, 2015, in Amsterdam and registered with the Chamber of Commerce under registration number 64636917.

Status holder: a (natural) person residing in the Netherlands who holds a valid residence permit and is subject to the hosting arrangement.

Host: a (natural) person who offers part of their home to the Status holder for temporary accommodation.

COA: Centraal Orgaan opvang Asielzoekers (Central Agency for the Reception of Asylum Seekers).

Match: the act of connecting a Status holder with a Host with the intent of facilitating the Status holder’s stay with the Host.

2. Terms and Conditions

These general terms and conditions apply to the relationship between Takecarebnb on the one hand and the status holder and the host on the other hand. The applicability of any terms and conditions other than these is excluded, unless explicitly agreed otherwise in writing.

3. Platform

3.1 Takecarebnb functions solely as a platform to connect supply and demand between hosts and status holders. Takecarebnb is expressly NOT involved in any actual agreements between hosts and status holders.

3.2 Hosts and status holders must explicitly arrange their mutual relationship themselves—without interference from Takecarebnb.

3.3 For this reason, Takecarebnb cannot exercise any control over the quality, safety, legality, or competence of either party, nor the accuracy of the information exchanged between them when making mutual agreements.

3.4 If desired, Takecarebnb proposes a working method within the framework of the lodging scheme as established by the COA. Takecarebnb is not responsible for changes, errors, misinterpretations, or (unexpected) consequences of the lodging scheme.

3.5 Takecarebnb does not in any way guarantee housing for status holders.

4. Purpose

4.1 Takecarebnb was founded with the vision of contributing to the integration of refugees into Dutch society. As more refugees come to the Netherlands, polarization within Dutch society appears to increase. This can lead to fear or misunderstanding, as unfamiliarity often breeds dislike. In the Netherlands, many individuals and families strive to assist refugees in various ways. Many have indicated that refugees are welcome to stay in their homes for a (short) period. Takecarebnb aims to contribute by bringing Dutch people and status holders into contact with one another.

4.2 By accepting these terms and conditions, the host—or status holder—acknowledges that Takecarebnb is an idealistic foundation that seeks, without profit motives, to create connections between hosts and status holders.

4.3 Takecarebnb strives to prevent issues between hosts and status holders as much as possible. Takecarebnb assists in assessing whether a match will work out, in making agreements between the host and status holder, and in answering questions. All of this is done in an advisory capacity: Takecarebnb accepts no responsibility for the consequences of these actions.

5. Applicable Regulations

5.1 Status holders and hosts must familiarize themselves with and be aware of the regulations that apply to offering a place by a host to a status holder when making mutual agreements.

5.2 Takecarebnb assists in collecting and clarifying these regulations but is not responsible for their completeness or interpretation.

5.3 We ask each host family/main resident and all adult family members to provide a Certificate of Conduct (VOG), which can be requested free of charge through Takecarebnb. A condition is that Takecarebnb must have received the VOG(s) before the start of a match. Without these VOGs, the stay cannot begin.

5.4 The status holder must be registered at the host family’s address in the BRP (Personal Records Database). The host family/main resident will be informed before the start of a match about the Personal Records Database Act (BRP) and the potential short- or long-term consequences of registering a new resident at their address.

6. Limitation of Liability

6.1 Takecarebnb cannot be held liable in any way for any (alleged) material and/or immaterial damage resulting from (alleged) agreements between a status holder and a host.

6.2 In the event of complaints about a host or status holder, Takecarebnb will investigate the validity of the complaint. If the complaint is justified, Takecarebnb may terminate the collaboration with the host or status holder in question. By accepting these terms and conditions, the host or status holder acknowledges that Takecarebnb cannot be held liable or obligated to pay damages in such cases.

6.3 If—and insofar as—a (Dutch) court nonetheless determines that Takecarebnb is liable for the (consequential) damage of the status holder, host, or a third party and is required to compensate the damage in whole or in part, the amount of compensation will be limited to a maximum of EUR 250.00.

7. Registration Costs

7.1 Registration as an interested party on takecarebnb.org is entirely free. This applies to both hosts and status holders.

7.2 Takecarebnb, as an idealistic foundation, relies on donations and contributions from third parties.

8. Privacy

8.1 By registering with Takecarebnb, the status holder agrees to receive information and messages from Takecarebnb. The status holder can unsubscribe from these messages at any time via the unsubscribe link in the communication. The manner in which personal data and email addresses are processed is described in the Privacy Statement.

8.2 By registering with Takecarebnb, the host agrees to receive information and messages from Takecarebnb. The host can unsubscribe from these messages at any time via the unsubscribe link in the communication. The manner in which personal data and email addresses are processed is described in the Privacy Statement.

9. Intellectual Property

9.1 The intellectual property rights to all texts, images, and software on the takecarebnb.com website belong to Takecarebnb. Nothing on the takecarebnb.com website may be copied, reproduced, or distributed without written permission. Any use requires prior consent from Takecarebnb. All images, data, texts, etc., placed on the takecarebnb.com website must be free of rights.

9.2 Takecarebnb cannot be held liable under any circumstances for possible copyright infringements in materials placed in advertisements. Any claims regarding the publication of advertisements will be referred to the individual or organization responsible for placing the material. However, Takecarebnb reserves the right to use these materials for promotional purposes.

10. Code of Conduct for Digital Messages

10.1 Takecarebnb reserves the right to reject or remove non-serious, offensive, insulting, or commercial advertisements or messages.

10.2 Takecarebnb also reserves the right to exclude housing offers without providing a reason if they are in violation of the law, public order, morality, and/or these terms and conditions. Such exclusions are without prejudice to Takecarebnb’s right to take legal action and/or claim damages.

11. Jurisdiction and Applicable Law

11.1 These terms and conditions are governed by Dutch law.

11.2 In the event of a dispute between Takecarebnb and the status holder or host (including summary proceedings and requests for seizure orders), the Amsterdam court has exclusive jurisdiction, except where mandatory law explicitly dictates otherwise.

12. Amendments to Terms and Conditions

Takecarebnb reserves the right to amend these terms and conditions and apply the amended terms to existing agreements, with such amendments taking effect thirty days after notification to status holders and hosts.
